The Civil Guard of the Region of Murcia has developed an investigation to clarify the theft of a mobile phone in Pacheco Tower, which has resulted in the investigation of the complainant and alleged victim of theft, as well as his partner.
Both have been instructed as alleged perpetrators of crime simulation and fraud.
The proceedings began when members of the Prevention of Citizen Security of the Benemérita collected a complaint for the theft of a mobile telephone terminal in Torre Pacheco.
Apparently, the complainant, taking advantage of an oversight, had been robbed of the bag that carried her mobile phone.
Following the complaint, the Civil Guard opened the corresponding investigation to verify the alleged crime and, where appropriate, clarify it, so a series of investigations were carried out to collect all possible indications of the criminal act.
As a result of the investigation and following a series of incongruities, the civil guards began to suspect the truthfulness of the crime reported, so not discarding any hypothesis, the line of investigation of the simulation of crime and false accusation gained weight.
The inquiries carried out allowed us to confirm that both the complainant and her partner were still using the reported smartphone as stolen.
It was also found that they had reported the alleged theft to their insurance company, which compensated them with a terminal of similar characteristics and benefits.
Once all the necessary evidence has been obtained, during the last days the Civil Guard has located and investigated the complainant and his partner, who have been instructed as alleged perpetrators of the crime simulation offenses, for false denunciation, and scam, for the claim made to the insurance.
During the proceedings, the civil guards seized the mobile phone object of the investigation, which has been brought to justice.
The Civil Guard informs citizens of the criminal responsibility that involves reporting criminal acts that have never been committed, as well as the damage caused by detracting police forces to investigate false crimes that, in addition, usually generate great social alarm among the population, mainly, when robberies are reported with violence.
The Criminal Code establishes that who, before any judicial or administrative official who has the duty to investigate, pretends to be responsible or victim of a criminal offense or denounces a non-existent one, causing procedural actions, will be punished with a fine of six to twelve months.
Those investigated, the effects seized and the proceedings taken have been made available to the Court of Instruction of San Javier (Murcia).
